Part 122: Registration of manufacturers and exporters – ITAR - International Traffic in Arms Regulations

ITAR - International Traffic in Arms Regulations 122.4(b): Give 60 days' advance notice of any sale or transfer of ownership or control to a foreign person

What does 122.4(b) require?

A registrant must notify DDTC by registered mail at least 60 days before any intended sale or transfer to a foreign person of ownership or control of the registrant or any of its entities; the notice lets DDTC decide whether to invoke section 38(g)(6) of the AECA and does not relieve the registrant of the approval needed to release technical data or export defense articles to the foreign acquirer (122.4(b)).
