Part 122: Registration of manufacturers and exporters – ITAR - International Traffic in Arms Regulations

ITAR - International Traffic in Arms Regulations 122.2: Submit a complete and certified Statement of Registration and renew it on time

What does 122.2 require?

The intended registrant submits Form DS-2032 electronically, signed by an empowered U.S.-person senior officer, with evidence that it is incorporated or authorised to do business in the United States; it may list subsidiaries and affiliates that are more than 50 percent owned or otherwise controlled, and may not create new entities to reduce fees (122.2(a)). A senior officer must certify whether the registrant, its parent, subsidiaries or affiliates, or any of their senior officers or directors, have been indicted, charged or convicted under 120.6 statutes or a foreign defense-export law carrying more than one year's imprisonment, or are ineligible, and whether the registrant is foreign owned or controlled, identifying the ultimate foreign owners (122.2(b)). Registration is renewed annually, with the renewal request submitted at least 30 and no earlier than 60 days before expiry; a lapsed registrant that kept operating must pay fees for the intervening period (122.2(d)-(f)).
