Clause 6.4: Labour practices – ISO 26000:2010

ISO 26000:2010 6.4.3: Labour practices issue 1: Employment and employment relationships

What does 6.4.3 require?

An organization should: be sure that everyone who works for it, whether a woman or a man, is legally recognised either as an employee or as self-employed; not escape an employer's legal duties by dressing up as something else a relationship the law would treat as employment; value job security and plan its workforce actively so as to avoid casual or excessive temporary work, except where the work really is short-term or seasonal; when operations change, for instance through a closure, give reasonable notice and prompt information and, with workers' representatives, look at how to lessen the harm; offer equal opportunity and not discriminate, directly or indirectly, in any aspect of how it treats workers; put an end to arbitrary or discriminatory dismissal; protect the personal data and privacy of workers; contract or subcontract work only to organizations that are legally recognised or that can and will take on an employer's duties and offer decent conditions, use only lawful labour agencies, and treat homeworkers at least as well as other paid workers; avoid profiting from labour practices that are unfair, abusive or exploitative when used by its partners, suppliers or subcontractors, making reasonable efforts in proportion to its influence (such as contract terms, unannounced visits and inspections, and due diligence on contractors and agencies) and applying any supplier labour code in line with the Universal Declaration and ILO standards; and, when it operates across borders, try to increase jobs, career development, promotion and progression for people from the host country and to use local businesses and materials.
