Distributors must act with due care in relation to the Directive's requirements. Before making a product available they must check that it carries the CE marking where required, comes with the declaration or attestation, the required documents and instructions and safety information in a language end-users in that Member State easily understand, and that the manufacturer and importer have met their identification, marking and contact duties. A distributor that considers or has reason to believe a product does not meet Annex II must not supply it until it is brought into conformity and, where it presents a risk, must inform the manufacturer or importer and the market surveillance authorities.
