Importers may place only compliant products on the market. Before doing so they must check that the manufacturer has carried out the right Article 13 procedure and drawn up the technical documentation, that the product carries the CE marking where required and comes with the declaration or attestation and required documents, and that the manufacturer has met the identification, Ex marking and contact detail duties. An importer that considers or has reason to believe a product does not meet Annex II must not place it on the market until it is brought into conformity, and where it presents a risk must inform the manufacturer and the market surveillance authorities.
