Chapter 2: Obligations of manufacturers and authorised representatives – EU ATEX Directive (Directive 2014/34/EU)

EU ATEX Directive (Directive 2014/34/EU) 7: Appoint authorised representatives by written mandate covering at least the minimum tasks

What does 7 require?

A manufacturer may appoint an authorised representative by written mandate, but the design duty of Article 6(1) and drawing up the technical documentation cannot be delegated to it. The mandate must at least let the representative keep the declaration or attestation and the technical documentation available to market surveillance authorities for 10 years after placing on the market, supply an authority on reasoned request with the information and documents needed to show conformity, and cooperate with authorities on action to eliminate risks.
