EAR - Export Administration Regulations 750.7: Issuance of licenses and licensee responsibilities

What does 750.7 require?

A licence authorises only the items, end uses and parties in the application and letters of explanation, subject to its conditions; the applicant must inform other parties such as ultimate consignees and end users of the licence's scope and the conditions that apply to them, and where the licence requires, obtain their written acknowledgement. Licences rest on the applicant's representations and are void from issue if obtained by false or misleading statements or concealment. A technology licence to an entity also covers its permanent and regular foreign employees at authorised facilities unless a condition limits it. Listed non-material changes (price decreases, tolerance-covered increases, new intermediate consignee in the destination country, transshipment in Country Group B on a through bill of lading, address changes within the country, ECCN conforming changes, transfers among named end users, MT minimum software and technology, certain Russia and Belarus divestiture additions) need no replacement licence; other changes need a replacement licence, and name changes need BIS approval by advisory opinion absent a change in ownership or legal status. The exporter-licensee is responsible for proper use and all terms and conditions (with the foreign principal in routed transactions); commodity licences are limited by quantity and value; validity is generally four years (one year for short supply; emergency licences to the end of the following month), with extensions by written request; temporary export licensees must apply to dispose of items not returned; intermediate consignees in General Prohibition Eight countries must be notified once known; original and replacement licences are kept; conditions lapse when items become eligible for an exception or NLR; and all licences and shipping records are kept under Part 762.
