A solicitation is a communication the lawyer or firm initiates toward a particular person whom the lawyer knows or should know needs legal help in a specific matter, offering or appearing to offer to take it on. Where pecuniary gain is a significant motive, live person-to-person solicitation is barred, with exceptions for other lawyers, for people with family, close personal or prior business or professional ties to the lawyer, for contacts made under a public or charitable legal services organisation or under a genuine political, social, civic, fraternal, employee or trade body whose purposes include legal services related to the contact, and for businesses, nonprofits, government bodies and people who routinely use that kind of legal service in business. Even an otherwise permitted approach is forbidden where the person's physical, emotional or mental state makes a sound hiring decision unlikely, where the person has said they do not want to be approached, where coercion, duress, fraud, overreaching, harassment, intimidation or undue influence is used, or where the subject is a personal injury, wrongful death, accident or disaster involving the person or a relative and the event happened fewer than forty days earlier. Communications that the law authorises or a tribunal orders fall outside the rule.
