An accredited person whose accreditation authorises it to initiate a type of CDR action contravenes the section (civil penalty) if, in proposing to a potential CDR consumer that it give a valid instruction for a CDR action of that type, or in giving such an instruction, it fails to act efficiently, honestly and fairly. The duty is in force but has nothing to bite on until a type of CDR action is declared under section 56ACA and rules for it are made; none had been declared on the Federal Register of Legislation as at 2026-09-25.
