Australia Plumbing and Fire Sprinklers Award 2020 (MA000036)
Part 7: Workplace Delegates, Consultation and Dispute Resolution – Australia Plumbing and Fire Sprinklers Award 2020 (MA000036)

Australia Plumbing and Fire Sprinklers Award 2020 (MA000036) 32: Clause 32: follow the dispute resolution procedure

For a dispute about an award matter or the NES, the parties must first try to resolve it at the workplace between the employees concerned and the relevant supervisor, then with more senior management in a timely way. If still unresolved after those steps, either party may take it to the Fair Work Commission, which may use mediation, conciliation, consent arbitration or any other method the Act allows. Each party may appoint a person or organisation to support or represent them. While the process runs, work continues under the award and the Act, and an employee must not unreasonably refuse a safe and appropriate direction to perform work, subject to work health and safety laws. The Act has its own procedures for disputes about flexible work (s 65B), casual conversion (s 66M), parental leave extensions (s 76B) and the right to disconnect (s 333N).
