An employer that is not a small business employer must give a workplace delegate access to up to 5 days' paid time in normal hours for initial training, and 1 day or more in each later year, for training on representing eligible workers' industrial interests. Each year from 1 July the employer need not fund more than one delegate per 50 eligible workers, counting full-time, part-time and regular casual eligible workers on the day of the request. Pay is what the delegate would have earned for rostered hours that day. The delegate must give at least 5 weeks' notice (unless a shorter period is agreed) of dates, subject, daily times and provider, and an outline on request; the employer must say whether it is approved at least 2 weeks before the training starts, and must not unreasonably withhold approval; the delegate must provide evidence of attendance within 7 days after the training.
