Where the employer has 10 or fewer employees (whose employees do not work next to other building and construction trades), it may require an employee to work on the scheduled RDO, in which case the employee nominates another day to take off at mutual convenience. The employer must not alter the scheduled RDO without at least 5 days' prior notice.
