Consultation is two-way: talking, listening, raising concerns, seeking and sharing views and information, and considering what workers say before deciding (WHS Act s 48). It requires sharing relevant information, giving a reasonable opportunity to express views and raise issues, giving a reasonable opportunity to contribute to decisions, taking views into account, advising the outcome in a timely manner, and including the health and safety representative where there is one. Telling workers about a decision after it is made is not consultation. Workers should be encouraged to ask questions, raise concerns, report problems and make recommendations. Agreement is the objective, though not always achieved.
