A PCBU must consult, so far as is reasonably practicable, workers who carry out work for the business and are or are likely to be directly affected by a health and safety matter (WHS Act ss 47 and 48), including contractors, labour hire workers, outworkers, apprentices, trainees, work experience students and volunteers. Workers usually know the physical and psychosocial hazards of the plant they use, so consultation helps identify hazards and controls. It means sharing information, giving a reasonable opportunity to express views and contribute, taking views into account, advising workers of the outcome in good time and including any health and safety representative. It must happen as early as possible when new plant is planned or the way plant is used changes, and is not telling workers of a decision after the event.
