A PCBU must consult, so far as is reasonably practicable, workers who carry out work for it and are or are likely to be directly affected by a WHS matter (WHS Act s 47), following any agreed procedures. Workers include employees, contractors and their employees, labour hire workers, outworkers, apprentices, trainees, work experience students and volunteers. Consultation must include any health and safety representatives (s 48): share relevant information, give workers a reasonable chance to express views and raise issues, take their views into account before deciding, and advise them of outcomes in good time. Workers with vulnerabilities, such as women, young workers, culturally and linguistically diverse workers, LGBTIQA+ workers and workers with disability, must be given the chance to take part. Because workers may hesitate to raise bullying or sexual harassment, the PCBU should consider anonymous surveys or reporting and use several methods where needed, agreed with workers.
