Those who design, manufacture, import, supply or install plant or structures used for excavation work must ensure, as far as reasonably practicable, that what they provide carries no risk to health and safety (WHS Act Part 2 Division 3, ss 22 to 26). This includes carrying out testing and analysis and providing particular information on the plant or substance. The WHS Regulations support these duties by requiring manufacturers to consult plant designers, importers to consult plant designers and manufacturers, and the person commissioning construction work to consult the designer of the structure.
