A PCBU must consult, so far as is reasonably practicable, workers who are or are likely to be directly affected by a health and safety matter, including contractors and subcontractors and their employees, on-hire workers, outworkers, apprentices, trainees, work experience students and volunteers, and workers may be represented by their HSR; consultation is required at each step of the risk management process (WHS Act ss 47 and 48). Where decisions are made before workers are engaged, consult as the work progresses. Consultation may be face to face, by phone or electronically, and face to face may suit culturally and linguistically diverse or inexperienced workers; builders can pass information through subcontractors but should follow up that it reached workers and that feedback came back. Toolbox talks and pre-start meetings should keep records of topics, attendees and feedback, run as a program and be checked for effect; anonymous surveys or reporting should be considered for psychosocial hazards such as bullying or sexual harassment.
