Construction involves several duty holders at once (PCBUs who carry out, design or commission the work, principal contractors, those with management or control of the workplace, those doing high risk construction work, officers, workers and other persons), and one person often holds several roles; a subcontractor is a PCBU and can also be a worker. Where two or more people hold the same duty, each must comply, limited by the extent of their capacity to influence and control the matter (or the capacity they would have had but for an arrangement that purports to limit it). Duties cannot be contracted out, though duty holders may arrange for one to do things that help the others comply, for example one providing first aid facilities that the other confirms are in place. A principal contractor or builder not present on site must still ensure the work is done safely, for example by checking subcontractors' procedures and SWMS and visiting to verify.
