Public holidays are provided by the NES and a day or part-day may be substituted by agreement. If a full-time employee's rostered or accrued day off falls on a public holiday, the employer must pay an extra day's pay, give an alternative day off within 28 days, or add a day's annual leave (pro rata for a part-day holiday). A part-time employee due to work on a public holiday under their agreement may be absent and must then be paid for the ordinary hours they were to work; if they work, they are paid under clause 35.
