The employer must pay ordinary hours at the percentages of the ordinary hourly rate in Table 14 of the current award (consolidated to 1 July 2026, read 30 September 2026) for Saturdays, Sundays and public holidays, and the per-hour additional amounts for weekday hours from 7.00 pm to midnight and midnight to 7.00 am, with separate full-time and part-time and casual columns. Where more than one penalty would apply, only the highest is paid, though the missed meal break payment is additional. Public holiday work carries a minimum payment of 4 hours (full-time and part-time) or 2 hours (casual), counting continuous shift time either side. By agreement a full-time or part-time employee may take the public holiday alternative (a lower rate plus equivalent paid time added to annual leave or a day off within the week or 28 days, extendable to 6 months by written agreement, with payment if not taken or on termination). Full-time and part-time employees working on Christmas Day falling on a weekend when it is not a public holiday are paid the rate in 29.4(g) and a substitute day off.
