Time off instead of overtime payment needs a separate written agreement for each pay period's overtime (emails suffice) stating the hours and when worked, the agreement, and payment at the overtime rate on request in the next pay period; time off is hour for hour, taken within 6 months, and paid out at the overtime rate on request, if not taken within 6 months, or on termination; the agreement is kept as an employee record and no undue influence may be exerted. An employee recalled to work overtime after leaving the premises must be paid at least 2 hours at the overtime rate. An employee working overtime takes a paid 20-minute rest break after each 4 hours if required to continue.
