Australia Franchising Code of Conduct (Franchising Regulations 2024) s26-27: ss 26 and 27 Obtain signed statements about the disclosure, the Code and independent advice before entry

A franchisor must not enter into, renew, transfer or extend a franchise agreement until the franchisee has given a signed statement that it received, read and had a reasonable opportunity to understand the disclosure document and the Code, and must not enter a new agreement until it holds, for each kind of adviser the Code names (independent legal adviser, independent business adviser and independent accountant), either the adviser's signed statement that advice was given or the franchisee's signed statement that it was told to seek advice and chose not to.
