Productive capacity must be assessed under the supported wage system by an approved assessor after consulting the employer, the employee and, at the employee's option, a union they can join. Each assessment is recorded in an SWS wage assessment agreement, kept among the employer's time and wages records, signed by the employee and employer, and lodged with the Fair Work Commission by the employer. Where an interested union is not a party, the Commission refers the agreement to it by certified mail and it takes effect unless an objection is notified within 10 working days. The percentage should be reviewed annually or more often on a reasonable request, using the SWS procedures.
