Australia Electrical, Electronic and Communications Contracting Award 2020 (MA000025) 29: Clause 29: resolve award and NES disputes through the staged procedure

A dispute about an award or NES matter must first be discussed between the employees involved and the relevant supervisor, then, if unresolved, promptly with more senior management. If it still cannot be resolved at the workplace after those steps, either party may take it to the Fair Work Commission, and the parties may agree the process (mediation, conciliation or consent arbitration); otherwise the Commission may use any method the Act allows. Each party may appoint a person or organisation to support or represent them. While the procedure runs, work continues under the award and the Act, and an employee must not unreasonably refuse a safe and appropriate direction to perform work at the same or another workplace, subject to work health and safety legislation. The Act has separate dispute procedures for flexible working requests (s 65B), casual conversion (s 66M), unpaid parental leave extensions (s 76B) and the right to disconnect (s 333N).
