Part 7: Workplace Delegates, Consultation and Dispute Resolution – Australia Electrical, Electronic and Communications Contracting Award 2020 (MA000025)

Australia Electrical, Electronic and Communications Contracting Award 2020 (MA000025) 26A.8: 26A.8 Give workplace delegates paid time for representation training

Employers other than small business employers must give a workplace delegate paid time during normal working hours of up to 5 days for initial training, and one day or more in each later year, to attend training on representing eligible workers' industrial interests. In each year from 1 July, the employer need not fund more than one delegate per 50 eligible workers, counted on the day of the request as full-time, part-time and regular casual employees. Pay is what the delegate would have earned for the hours they would have worked that day under their roster or the employer's requirements. The delegate gives at least 5 weeks' notice (or less by agreement) of the dates, subject, daily times and provider, and an outline of content if asked. The employer must tell the delegate at least 2 weeks before the training starts whether paid time is approved, and must not unreasonably withhold approval. The delegate provides evidence of attendance within 7 days after the training.
