A Class I or II permit may be transferred only after the holder gives the director written notice at least 30 days before the transfer with the permit number and expiry, both parties' contacts, the name and title of the person accepting responsibility with a signed acceptance, the equipment, a written agreement fixing the date of transfer of responsibility, coverage and liability, provision for fees due, and the new permittee's technical and financial capability (qualifications of the responsible operators, a chief financial officer's statement, and environmental enforcement history of principal operators for five years or a filed A.R.S. 49-109 disclosure). The director may deny within 10 working days; silence means approval.
