In a county of two million or more people or a serious PM-10 area, a person with a fugitive dust permit must implement that permit's control measures, including wind-related ones, as soon as practicable before and during a day forecast as high risk for dust generation. The director may require a person who owns or conducts a dust-generating operation (land clearing, earthmoving, discing, excavation, construction, demolition, bulk material handling, storage piles, outdoor equipment, staging areas, unpaved roads, initial landscaping) and who failed to choose and apply an applicable listed best management practice on such a day to obtain the dust action general permit, which carries monitoring, recordkeeping and reporting. Voluntary practices on moderate-risk days count as mitigation.
