A person who begins a regulated agricultural activity covered by the agricultural general permit adopted by the best management practices committee must comply with it immediately, using at least one listed best management practice in moderate PM-10 nonattainment areas and at least two in serious areas, with the permit's records and reporting. On a first non-compliance the director may order the person to submit, within not less than 60 days, a plan to the natural resource conservation district naming the practices to be used; on a second, a plan to the department; failure to follow that plan can lead to revocation of the general permit and a requirement for an individual permit under 49-426 with enforceable practices.
