APES 110 Code of Ethics for Professional Accountants (including Independence Standards) 260: Responding to non-compliance with laws and regulations (members in business)

What does 260 require?

A Member in Business who becomes aware of actual or suspected non-compliance with laws or regulations (NOCLAR) must obtain an understanding of the matter, address it with superiors or those charged with governance, and take further action in the public interest where needed, which may include disclosure to an appropriate authority. Senior Members have heightened duties to rectify, remediate and deter the non-compliance and to assess whether further action is required if the response is inadequate. The Member documents the matter, the discussions held and the decisions reached, and is protected in disclosing in good faith. The section covers laws that affect the financial statements and laws fundamental to the entity's business or licence to operate.
