AML/CTF Rules 2025 (Australia) R8-7: Relying on the transfer of value exemptions only where their conditions are met

Part 5 of the Act does not apply to item 29 to 31 services for money or property (not virtual assets) provided through a foreign establishment under that country's FATF-based law where the value stays in that country or moves within the European Economic Area; to transfers between financial institutions acting for themselves, including SWIFT transfers between supervised financial institutions; or to transfers instructed by a cheque drawn on the ordering institution. The ordering institution's collection and verification duties do not apply to merchant payments and refunds, verification is not required for pre-commencement customers, or for customers who have completed CDD where the service starts before 1 July 2030, if there is no reason to doubt the payer information, and pass-on duties do not apply to transfers to self-hosted wallets.
