AML/CTF Rules 2025 (Australia) R6-8: Beneficial owners that cannot be identified, or do not exist: record the steps and identify the chief executive

What does R6-8 require?

Where a body corporate, partnership or association customer has beneficial owners the entity cannot identify despite all reasonable steps, it is treated as having established them only if it records the steps and difficulties, collects the identity of the chief executive officer or equivalent, and verifies that information with reliable and independent data to the extent the customer's risk requires. Where the entity establishes the customer has no beneficial owners, it must establish the identity of the chief executive officer or equivalent.
