AML/CTF Rules 2025 (Australia)
Part 6 Divisions 1 and 2: Initial customer due diligence minimums and delayed verification – AML/CTF Rules 2025 (Australia)

AML/CTF Rules 2025 (Australia) R6-6: When on-behalf persons and beneficial owners are taken to be established (listed companies, government control, trusts)

What does R6-6 require?

For a customer that is not a trust and not taking a life or sinking fund policy, establishing the customer's identity also establishes any person on whose behalf the customer receives the service, and their PEP and sanctions status; for a trust, identifying the beneficiaries or describing each class does so. Beneficial owners are taken to be established where the customer is a listed public company subject to beneficial ownership disclosure, a government body, or controlled by either; where such a company or body owns part of the customer without controlling it, its own beneficial owners need not be identified as owners of the customer, and their PEP and sanctions status is taken to be established.
