Part 6 Divisions 1 and 2: Initial customer due diligence minimums and delayed verification – AML/CTF Rules 2025 (Australia)

AML/CTF Rules 2025 (Australia) R6-13: Delayed verification for account opening, deposits, fast market transactions and services provided overseas

What does R6-13 require?

An account may be opened and deposits accepted before CDD is complete, provided no money, property or virtual assets are transferred or made available until it is. A broker may execute an acquisition or disposal of securities, derivatives or foreign exchange contracts on a declared market that must be done quickly, provided it is not a managed investment scheme interest needing a product disclosure statement, the entity does not take cash or virtual assets to fund it, release sale proceeds, pass on acquired assets or refund the price until CDD is complete, and CDD is completed within 5 business days. A service through a foreign establishment may proceed before CDD where that country's FATF-based law allows and the entity complies with its local KYC law.
