Surveillance is treated as meeting Part 3 where the worker consents to it for some purpose other than watching the worker and it stays within what was agreed; consent by a body that represents a substantial share of the workforce there counts as the worker's consent. An employer relying on this keeps the agreement and holds the surveillance to it.
