Terms of Service

The Platform is an AI-powered compliance intelligence tool that provides self-assessment questionnaires, framework browsing, cross-framework control mapping, AI advisory chat, and related features. It is designed to help organisations plan and evaluate their compliance posture.

You should not rely on Platform outputs as a substitute for professional advice from a qualified lawyer, auditor, or compliance consultant. Always independently verify information against the official, authoritative version of any standard or regulation and consult a qualified professional before making compliance decisions.

The assessments available on the Platform are self-assessment diagnostic tools authored by The Art of Service. They are not official assessments, certifications, audits, or accreditations issued by or on behalf of any standards body, regulatory authority, or framework owner.

Completing an assessment on the Platform does not result in any certification, credential, or official compliance status. Assessment results reflect your own self-reported inputs and are intended to help you identify areas for further investigation.

The Platform uses artificial intelligence to generate advisory responses, framework summaries, control descriptions, and other content. AI-assisted content may contain errors, omissions, or inaccuracies.

We do not warrant the accuracy, completeness, or reliability of any AI-assisted content. You are responsible for independently verifying any information before acting on it.

Framework summaries, control descriptions, and cross-framework mappings on the Platform are AI-assisted interpretations created for educational and compliance planning purposes. They do not reproduce or replace the official standards or regulations.

For the definitive text of any standard or regulation, refer to the authoritative source published by the relevant standards body or regulatory authority. Where available, the Platform provides links to official sources.

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must notify us immediately at support@theartofservice.com if you become aware of any unauthorised use of your account.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Platform, other accounts, or any systems or networks connected to the Platform.
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the Platform, except as permitted by our robots.txt.
• Resell, redistribute, or sublicense access to the Platform or its content without our prior written consent.
• Misrepresent your identity, qualifications, or affiliation when using the Platform.

The Platform offers Free, Professional, and Enterprise tiers. Paid subscriptions are billed through Stripe. By subscribing, you authorise recurring charges at the applicable rate until you cancel.

You may cancel your subscription at any time through the account settings page. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect existing billing periods.

9.1 Platform Content

The Platform, including its design, software, assessment questions, AI-assisted content, cross-framework mappings, and knowledge graph, is owned by or licensed to The Art of Service and is protected by copyright and other intellectual property laws.

9.2 Your Content

You retain ownership of any data you input into the Platform, including assessment responses, notes, and uploaded content. You grant us a limited licence to store and process your content solely to provide the Platform's services to you.

9.3 Third-Party Trademarks

Framework names, standard numbers, and related marks referenced on the Platform are the trademarks or registered trademarks of their respective owners. The Art of Service is not affiliated with, endorsed by, or authorised by any standards body or framework owner unless explicitly stated.

To the maximum extent permitted by applicable law, The Art of Service and its directors, employees, and agents shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or business opportunities.
• Damages arising from your reliance on any information, assessment result, AI output, framework summary, control mapping, or recommendation provided by the Platform.
• Compliance failures, regulatory penalties, or audit findings resulting from use of or reliance on the Platform.

Our total aggregate liability to you for all claims arising from or related to these Terms or the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the Australian Consumer Law.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or free of harmful components.
• Framework data, control mappings, assessment questions, or AI outputs are accurate, complete, current, or suitable for any particular compliance requirement.
• The Platform will meet your specific requirements or expectations.

You agree to indemnify and hold harmless The Art of Service, its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of or reliance on the Platform.
• Your breach of these Terms.
• Your violation of any applicable law or regulation.
• Any claim by a third party arising from your use of Platform outputs in your business operations.

We may suspend or terminate your account at any time if you breach these Terms or if we reasonably believe your use of the Platform poses a risk to us or other users. You may delete your account at any time by contacting us.

Upon termination, your right to access the Platform ceases immediately. Sections 2, 9, 10, 11, 12, and 15 survive termination.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
