Victoria Owners Corporations Act 2006
Part 7: Meetings, voting, proxies and resolutions – Victoria Owners Corporations Act 2006

Victoria Owners Corporations Act 2006 95-97: Unanimous, special and interim special resolutions

What does 95-97 require?

A unanimous resolution needs the total lot entitlements (ballot or poll) or total votes of all lots; a special resolution needs 75 per cent of total lot entitlements or 75 per cent of total votes. A special resolution that fails only because fewer than 75 per cent but more than 50 per cent voted in favour, with no more than 25 per cent against, becomes an interim special resolution, which takes effect after 29 days unless lot owners holding more than 25 per cent of lot entitlements petition against it (section 97). Section 90 lists what each kind of resolution is required for.
