Part 7: Meetings, voting, proxies and resolutions – Victoria Owners Corporations Act 2006

Victoria Owners Corporations Act 2006 89C-89H: Proxies: form, limits on numbers, revocation and no coercion

What does 89C-89H require?

A proxy must be in the approved form (regulation 8), is valid for the period it states (or 12 months), and a lot owner may revoke it in writing. Since the amending Act No. 4/2021 commenced a person may not hold proxies for more than the number of lot owners the Act and rules permit (section 89D and regulation 8A, which cap proxies for owners corporations of 20 or more lots at 5 per cent of lots, and allow rules under section 138A), a person must not require or demand a proxy as a condition of a contract or benefit (section 89G), and a term of a contract of sale limiting a purchaser's voting rights is void (section 89H).
