Section 35(1) of the Act applies so that an employer planning to seek an exemption under Part 7.2 must consult before applying, in line with Part 4 of the Act (consultation with employees and any health and safety representatives). The Authority may refuse an application unless reasonably satisfied that the Part 4 consultation duties of the Act were met, and r 541(1)(h) requires the application to describe the consultation.
