Victoria Occupational Health and Safety Act 2004 s91: s 91 Conduct limits on authorised representatives

Five things are prohibited for an authorised representative, each when done intentionally: obstructing or hindering an employer or employee unreasonably; threatening or intimidating an employer or employee; using or disclosing information obtained from an employer or employee for a purpose with no reasonable connection to exercising Part 8 powers; using, disclosing or handing on photographs, measurements, sketches or recordings made under s 89(1)(ba) for such an unconnected purpose; and using, or claiming to use, Part 8 powers for any purpose other than enquiring into a suspected contravention. Maximum penalty: 60 penalty units.
