Victoria Occupational Health and Safety Act 2004 s39: s 39 Preserve the incident site until an inspector arrives or directs

Where an employer or self-employed person has to notify an incident at a workplace, it is required (absent a reasonable excuse) to keep the site where it happened undisturbed until an inspector gets there, or until any other time an inspector specifies at the time of notification. Disturbance is still allowed to protect someone's health or safety, to assist an injured person involved, or to take essential steps that make the site safe or stop the incident happening again (s 39(2)). Maximum penalty: 240 penalty units (individual) or 1200 penalty units (body corporate). The offence is indictable (s 39(3)), though it may be heard summarily.
