Victoria Occupational Health and Safety Act 2004 s38-1: s 38(1) Notify the Authority immediately of a notifiable incident

Unless there is a reasonable excuse, every employer or self-employed person is required to tell the Authority straight away on learning that a notifiable incident (s 37) has happened at a workplace it manages and controls. Notification is not required where the only person hurt, harmed or put at risk by the incident is the employer or self-employed person itself (s 38(2)). Maximum penalty: 240 penalty units (individual) or 1200 penalty units (body corporate) (s 38(5)). The offence is indictable (s 38(6)), though it may be heard summarily.
