Victoria Occupational Health and Safety Act 2004 s38-4: s 38(4) Keep the incident record for at least 5 years and make it available

The duty holder must retain a copy of that written incident record for no less than 5 years. A copy must be open to inspection by: (a) any inspector; (b) anyone injured in the incident or seriously put at risk by it, or their representative; (c) the representative of anyone killed in the incident; and (d) where the duty holder is an employer, the health and safety representative of any designated work group its employees belong to, and every member of any health and safety committee it has set up. Maximum penalty: 240 penalty units (individual) or 1200 penalty units (body corporate) (s 38(5)).
