No qualified individual with a disability may be excluded from or discriminated against in a program offered through medical diagnostic equipment because the equipment is not accessible. All MDE a recipient purchases, leases (including renewals) or otherwise acquires after 8 July 2024 must meet the Standards for Accessible Medical Diagnostic Equipment until the scoping requirements are met: at least 10 percent of the units of each type of equipment in use, and no fewer than one, in physicians' offices, clinics, emergency rooms, hospitals and outpatient facilities, at least 20 percent in rehabilitation, physical therapy and other services specialising in conditions affecting mobility, dispersed proportionately across departments; and within two years after 8 July 2024 the recipient must have at least one accessible examination table and one accessible weight scale if it uses them. Existing MDE programs must be readily accessible in their entirety through reassignment, alternate locations, home visits or acquisition, giving priority to the most integrated setting, subject to the written fundamental alteration or undue burden decision and a specific defence where accessibility would alter diagnostically required characteristics. Staff must be able to operate accessible MDE, assist with transfers and positioning and carry out the program access obligation.
