Subparts H to K: effective communication, web, mobile and kiosk accessibility, accessible medical diagnostic equipment, procedures (84.77 to 84.98) – US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84

US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84 84.85-84.89: Apply the web exceptions narrowly (archived content, preexisting documents, third-party posts, secured individual documents, old social media), use conforming alternate versions only where direct accessibility is impossible, document any undue burden decision, and rely on the minimal-impact defence only where use is substantially equivalent

What does 84.85-84.89 require?

The web and mobile requirement does not apply to archived web content, conventional electronic documents available before the compliance date unless currently used to apply for, access or participate in the program, content posted by third parties not under contract, individualised password-protected or otherwise secured conventional electronic documents, and preexisting social media posts. Conforming alternate versions may be used only where direct accessibility is not possible because of technical or legal limitations; equivalent facilitation through other designs or methods is permitted where they give substantially equivalent or greater accessibility. Where compliance would fundamentally alter the program or impose undue burdens the recipient must still comply to the extent it does not, with the decision made by the head of the recipient or a designee after considering all resources and recorded in writing. Noncompliance that has such minimal impact that people with disabilities can still access the same information, engage in the same interactions, conduct the same transactions and otherwise participate with substantially equivalent timeliness, privacy, independence and ease of use is deemed compliant.
