A recipient must modify its policies to permit a service animal (a dog individually trained to work or perform tasks for a person with a disability) to accompany the person in all areas the public or participants may go; may exclude it only if out of control and not effectively controlled by the handler or not housebroken, and must then still offer the person the program without the animal; may ask only whether the animal is required because of a disability and what work or task it is trained to perform, never for documentation, and not even that where the task is readily apparent; must not charge surcharges (damage may be charged on the same basis as for anyone); is not responsible for the animal's care; and must make reasonable modifications to permit a trained miniature horse after assessing its size, control, housebreaking and safety. People with mobility disabilities must be allowed to use wheelchairs and manually powered aids wherever pedestrians go, and other power-driven mobility devices unless the class of device cannot be operated consistently with legitimate safety requirements, assessed on the device's dimensions and speed, pedestrian traffic, facility design, safety requirements and environmental risk; the recipient may ask only for credible assurance (a State disability placard or a verbal representation not contradicted by observable fact).
