Subpart G: general prohibitions, reasonable modifications, integration, service animals, mobility devices, direct threat and retaliation (84.68 to 84.76) – US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84

US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84 84.69-84.71: Do not discriminate against people in or completed from drug rehabilitation, maintain accessible features in operable working condition, and do not retaliate against or coerce anyone exercising section 504 rights

What does 84.69-84.71 require?

Part 84 does not protect current illegal drug use, but a recipient may not discriminate against a person who has completed or is participating in a supervised drug rehabilitation program or is erroneously regarded as using drugs, may not exclude a current user from health services or Rehabilitation Act services they are otherwise entitled to (a treatment program may exclude those using drugs while enrolled), and may adopt reasonable drug-testing policies. The recipient must maintain in operable working condition the features of facilities and equipment required to be accessible, allowing isolated or temporary interruptions for maintenance. It may not discriminate against anyone for opposing a prohibited act or for making a charge, testifying, assisting or participating in a section 504 investigation, proceeding or hearing, and may not coerce, intimidate, threaten or interfere with anyone exercising or helping others exercise section 504 rights.
