US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84 84.68(b)(7)-(8),(d)-(i): Make reasonable modifications unless they fundamentally alter the program, impose no screening-out eligibility criteria, serve people in the most integrated setting, charge no surcharges, protect associates, and base safety rules on actual risk

What does 84.68(b)(7)-(8),(d)-(i) require?

A recipient must make reasonable modifications in policies, practices or procedures when necessary to avoid discrimination on the basis of disability, unless it can demonstrate the modification would fundamentally alter the nature of the program or activity (no modification is owed to a person covered only under the regarded-as prong); must not impose eligibility criteria that screen out or tend to screen out individuals with disabilities unless necessary for the program; must administer programs in the most integrated setting appropriate; may not place a surcharge on individuals with disabilities to cover the cost of auxiliary aids, program accessibility or other required measures; may not exclude or deny equal services to an individual or entity because of the known disability of a person with whom they have a relationship or association; and may impose legitimate safety requirements only where based on actual risks rather than speculation, stereotypes or generalisations. Individuals may decline modifications, but representatives may not decline food, water, medical treatment or medical services on their behalf.
