US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84 84.68(a)-(b)(6): General prohibitions: no denial, unequal or less effective opportunity, unnecessary separate services, discriminatory criteria or methods of administration, site selection, procurement criteria or licensing practices

What does 84.68(a)-(b)(6) require?

No qualified individual with a disability may, solely on the basis of disability, be excluded from, denied the benefits of or discriminated against in a recipient's programs or activities. In providing any aid, benefit or service, directly or through contractual, licensing or other arrangements, a recipient may not deny the opportunity to participate or benefit, afford an unequal opportunity, provide an aid or service that is not as effective in affording equal opportunity to obtain the same result or reach the same level of achievement, provide different or separate aids or services unless necessary to make them as effective, aid or perpetuate discrimination by significantly assisting a discriminating body, deny participation on planning or advisory boards, or otherwise limit the enjoyment of any right or opportunity; may not deny participation in non-separate programs because separate ones exist; may not use criteria or methods of administration that have a discriminatory effect, defeat the program's objectives for people with disabilities or perpetuate another commonly controlled recipient's discrimination; may not select facility sites with those effects; may not use discriminatory criteria in selecting procurement contractors; and may not administer a licensing or certification program in a discriminatory way.
