Informal dispute settlement mechanisms – US Magnuson-Moss Warranty Act (15 USC 2301-2312)

US Magnuson-Moss Warranty Act (15 USC 2301-2312) 703.6-8: 16 CFR 703.6 to 703.8 Mechanism records, annual audit and openness

The mechanism keeps a full record for each dispute (parties, product, dates, submissions, evidence, decision and follow-up), indexes of disputes by warrantor, brand and model, of warrantor non-performance and refusals, and of disputes over 40 days, and semi-annual statistics in the prescribed categories, all retained for at least four years. It has an independent audit at least annually covering warrantors' awareness efforts, the indexes and a random sample of disputes with consumer contact, and sends each audit report to the FTC and makes it available at reasonable cost. Its statistics are public, its meetings open to observers, and each party can see and copy the records of its own dispute; staff and member qualifications are available on request.
