Authorisations for technical data and defense services – US ITAR and EAR - Export Control and Data Security

US ITAR and EAR - Export Control and Data Security ITAR 125.3 and 125.7: Export classified technical data only through the classified licensing and transmittal channels

Exports of defense articles or technical data classified by the U.S. or a foreign government need DDTC approval on Form DSP-85 with full details, facility security clearance codes of the U.S. parties, the cognizant security office of the party packaging the shipment and a DSP-83 signed by the applicant, foreign consignee, end user and a foreign government representative (125.3(a), 125.7). Approved classified data may be transferred or disclosed only under the NISPOM, unless DDTC guidance conflicts (125.3(b)), and classified licences are routed to the Defense Security Service, which returns the endorsed licence when the export is complete or the licence expires (125.9). Exemptions that cover classified information still require transmission under the NISPOM and a certification to the transmittal authority that the data stays within the authorised limits (125.4(a)).
